Terms of service
1. General:
Products purchased through www.dudushop.be are subject to the terms and conditions of Pas de Deux BV, with enterprise number BE 0443.623.263 and registered office at 9050 Gentbrugge, Maagd van Gentstraat 10 (hereinafter referred to as "the seller"). These terms and conditions apply whenever a reservation or order is placed through www.dudushop.be.
Anyone placing an order on the website (hereinafter referred to as 'the customer') confirms, by placing the order, to be a natural person and furthermore capable of acting.
Persons lacking legal capacity must be represented by their legal representative, who is also bound by these terms and conditions and must either fill in the order form themselves or give explicit permission for the incapable person to do so. The provisions of the following Article 11 regarding the processing of personal data remain in full force.
Placing an order implies an obligation to pay.
Placing an order on the website constitutes express acceptance of these general terms and conditions, which are published on the website. Acceptance of the general terms and conditions is necessary before placing an order. By placing an order, the customer declares to be familiar with and accept the seller's general terms and conditions. The general terms and conditions are always available and accessible via the website.
For each order, the general terms and conditions applicable at that time on the website and order confirmation are in force, excluding all possible older or newer provisions.
If one of these conditions, for any reason whatsoever, were not legally valid, the other conditions remain in full force.
What is not expressly stated in these terms and conditions is governed by the provisions of Belgian law.
The language of the concluded agreements is Dutch.
2. Offer and Order:
Orders via the website are assumed to be placed for non-professional purposes. These general terms and conditions apply only to consumers within the meaning of Book VI of the Economic Law Code, as inserted by the Law of December 21, 2013, inserting Book VI "Market Practices and Consumer Protection" into the Economic Law Code and inserting the definitions specific to Book VI, and the enforcement provisions specific to Book VI, into Books I and XV of the Economic Law Code, (Official Gazette December 30, 2013; err., Official Gazette January 20, 2014, err., Official Gazette March 18, 2014, err., Official Gazette March 24, 2014). Traders who wish to place an order for professional purposes must inquire with customer service if necessary.
The seller undertakes to process orders placed on the site as long as supplies last and within the limitations formulated in these terms and conditions. The online order can only be processed if the customer has clearly identified themselves in accordance with Art. 9.
The seller reserves the right to refuse orders in case of a serious suspicion of abuse of rights or bad faith, a serious suspicion of commercial purposes unacceptable to the seller, or when the stock of a specific item is exhausted.
An order is only final after acceptance of these general terms and conditions, prices, and the description of the offer. If anything in the offer or after ordering is unclear, the customer can always contact the seller by email at info@dudushop.be. All questions will be answered as quickly as possible.
3. Payment:
The prices are those stated on the website at the time of the order. All prices listed include 21% VAT.
Payment must precede delivery and is made via Bancontact, Visa, or MasterCard.
The order will only be executed after receipt of the paid amount. In the meantime, the ordered item will be reserved for 10 days, within which period the payment must reach the seller, otherwise the order will be canceled.
4. Order Confirmation:
After the system has accepted the payment, the seller confirms the order via email.
5. Delivery:
Delivery is currently only possible in the following countries: Belgium, Denmark, Germany, France, Luxembourg & Netherlands.
The delivery of the ordered item takes place at the address specified by the customer.
At the moment the delivery is handed over via bpost or DHL, an email is sent. Through the link with the tracking number provided therein, the customer can track the shipment via the carrier's e-tracker.
The delivery period only starts after receipt of payment. An effort is made to achieve the shortest possible delivery period. The delivery period is at least 1 working day and at most 5 working days after receipt of payment for delivery in Benelux. The seller is not liable for delays or non-delivery due to the carrier.
6. Return:
In accordance with articles VI 47-52 of the Economic Law Code, the consumer has a period of 14 days to revoke the agreement without giving any reason.
Each ordered item can be returned within fourteen calendar days.
The customer can also return the item by post within fourteen calendar days. The item must then be packaged in the original shipping box and sent, along with the return form, to the following return address: Pas de Deux BV, Maagd van Gentstraat 10, 9050 Gentbrugge.
The model withdrawal form can be downloaded from the webshop www.dudushop.be. All returns are at the customer's expense.
In any case, a return is only accepted if the item is clean, undamaged, unworn, and in its original packaging. Shoes may only be tried on inside and on a clean surface.
There are no costs or compensation associated with the return, in addition to any shipping costs.
After handling the return, the customer will be refunded by the seller in the same way as the customer made the payment.
7. Guarantee:
Any problem or defect related to the delivery of an item, damage, or qualitative deficiency must be reported in writing within seven days via a registered letter to the address: Pas de Deux BV, Maagd van Gentstraat 10, 9050 Gentbrugge or via email to info@dudushop.be.
If the delivery must be returned to the seller, this will be done in the manner described under 6. The shipping costs from Belgium (provided a personalized label is created as described above under 6) are borne by the seller. For shipments from other countries, the customer is responsible for the costs.
The seller offers the guarantees provided for by law.
The seller is not liable for force majeure, accident, improper use, or mishandling of an item by the customer.
An item with an accepted defect will be replaced or repaired free of charge. If the costs of repair are disproportionate, the seller reserves the right to replace the item or exchange it for a similar item.
8. Signature and Proof:
The customer accepts electronic evidence.
The customer is solely and exclusively responsible for the accuracy of all data they provide.
The final confirmation of the order by the customer is considered acceptance of the order at the stated price. The customer's confirmation is considered a signature and explicit acceptance of all transactions via the website.
9. Liability for Website Use:
The seller's website is intended to provide general information to the customer about the products and activities of the seller. The seller has only a best-effort commitment regarding access, the ordering process, delivery, or other services.
The seller has the right to suspend or terminate the site in whole or in part at any time due to maintenance, updating, or any other reason, even without prior warning.
The seller cannot be held liable for any hindrance or damage caused by the use of the internet, by any system failure, the intrusion of outsiders or a virus, nor for any information placed or processed by third parties on it or by any fact that can be considered force majeure.
10. Protection of Privacy:
The seller reserves the right to collect data from the customer solely for internal use, both directly through the collection of data provided by the customer during registration and/or ordering, and indirectly through, for example, the use of cookies, newsletter subscription, reservation request, or ordering.
In accordance with the Law of December 8, 1992 on the Protection of Personal Privacy, the customer has the right at all times to view, modify, and delete this data if they no longer wish to receive information about the seller's activities. For this, the customer can contact the seller.
11. Intellectual Property:
All parts of the seller's site, including the technology used for it, are the exclusive property of the seller and protected by copyright. Users who have their own website and who, even for purely personal use, want to set up an automatic link between their own site and the seller's homepage, must expressly request permission from the seller.
12. Jurisdiction and Applicable Law:
This agreement is subject to the provisions of Belgian law. All disputes will be settled by the courts in the jurisdiction of the seller.
